Las Vegas Hotel Guest Sues for Personal Injury Due to Mannequin Scare

A popular hotel in Las Vegas is facing a rather unique personal injury lawsuit that stemmed from a guest allegedly frightened by a life-like mannequin in his hotel room.

The plaintiff claimed that the hotel failed to warn him of the presence of a life-sized mannequin which in the dark caused him to rush out as he believed that there was another person in the room. While the hotel refrained from making any comments on the recent lawsuit, it said that around 2,500 of their hotel rooms had mannequins which were part of the rooms’ decorative memorabilia display.

Plaintiff’s Claims

The plaintiff said that he mistook the mannequin for a human being when he entered his dim hotel room in May 2015. His lawsuit further alleges that he sustained serious injuries to his body, organs, limbs, mind, and nervous system as he tried to flee the room thinking that the human figure was a person that was there to hurt him. He sought to recover compensation for his medical expenses, lost wages and earning potential, pain and suffering, and attorney’s fees.

Premises Liability

The hotel guest’s lawsuit is based on the principle that a property owner or manager such as a hotel operator has the duty to keep their premises reasonably safe at all times. If conditions are temporarily unsafe property owners must take reasonable steps to remedy the danger. When a dangerous condition on the property cannot be immediately remedied, the property owner or manager is required to post appropriate signage warning guests of the unsafe condition.

Importance of Proving Negligence

Premises liability is a branch of personal injury law which requires proof of negligence for a plaintiff to recover compensation. Not all injuries suffered in the premises or property of another person is compensable under this type of personal injury lawsuit. For a plaintiff to win a premises liability case, he must be able to prove that the property owner or manager failed to use reasonable care in connection with the property leading to the plaintiff’s injuries. If you sustained severe injuries while in someone else’s property, it’s important to consult an experienced personal injury attorney about your situation.
