Massachusetts Family Files Wrongful Death Claim Against Nanny

The parents of a young Massachusetts girl, who was killed in 2013 due to sudden, catastrophic swelling and bleeding of her brain, have filed a wrongful death lawsuit against their former nanny.

According to the lawsuit, which was filed in Middlesex County Superior Court, the family maintains that the nanny – who saw murder charges against her dropped not five months ago – is responsible for their first born child’s death, alleging “negligent, malicious, willful…reckless…or grossly negligent acts.”

The couple’s one-year-old child was rushed to Boston Children’s Hospital back in January 2013, where she died two days later for injuries to the brain. Initial medical reports suggested that the child died from abusive head trauma, or ‘shaken-baby syndrome’, as it is commonly known.

However, attorneys for the nanny have denied any wrongdoing, instead suggesting that the child may have had underlying or pre-existing medical concerns that could have contributed to her untimely death.

Dealing with the sudden, unexpected passing of a loved one is never easy. This is especially true in cases where the loss of life occurred due to someone’s negligence, otherwise known as wrongful death.

The Aftermath of Wrongful Death

Wrongful death affects hundreds of thousands of people across the country each year. And while losing a loved one does not come without its fair share of challenges, those left behind after such an untimely passing typically face additional stress, such as the burden of mounting medical costs, or the loss of primary financial support.

According to statistics from the Center for Disease Control (CDC) and the Department of Justice, wrongful death has become an increasingly prominent issue in recent years. In fact, wrongful death has been classified in a growing number of medical malpractice claims, prescription drug fatalities, and highway accidents.

Additionally, workplace hazards, premises liability and defective pharmaceutical drugs have been ranked by the CDC as some of the most common causes of wrongful death.

Under Nevada state law, plaintiffs in a wrongful death claim – typically reserved for parents, children, spouses, etc. of the victim – may sue for compensation or other damages, including:

  • Funeral costs
  • Medical bills
  • Pain and suffering
  • Financial support (lost wages)
  • Penalties against defendant
