Understanding Workers’ Compensation In Nevada

Workers’ compensation insurance is required for all employers in Nevada including Reno and Washoe County. If you suffer a workplace injury and your claim is successful, your medical care will be paid for. Additionally, you will receive a portion of your lost income while you recover. If your disability prevents you from returning to work, you could receive monthly checks for the rest of your life. If your claim is not successful, however, you could be stuck with enormous medical bills and no income to help you provide for your family.

Although fault does not need to be proven in Nevada workers’ comp cases, employers and their insurers will go to great lengths to deny or minimize claims. They cite preexisting conditions, deny that accidents occurred, and downplay the impact worker injuries have on their physical and mental abilities. Even when a work injury settlement is offered, it may not be enough to cover the costs involved with your care and basic living expenses.

Workers’ compensation, however, often works in conjunction with other liability insurances when a third party is involved in the incident. If the injury was caused by negligence on the part of someone besides your employer, you may be eligible to receive a settlement from the third party in addition to your workers’ compensation coverage.

What Benefits Are Provided By Workers’ Compensation?

Workers’ compensation benefits in Nevada can provide the following types of benefits to injured workers.

  • Compensation for lost wages: The amount of compensation you receive and the length of time for which you can collect benefits for lost compensation depend on the severity of your injuries and your ability to return to your job.
  • Temporary Total Disability (TTD): Temporary total disability is awarded when doctors have determined that you are unable to return to work for at least five days in a row or cumulatively for five days during a 20-day period.
  • Temporary Partial Disability (TPD): If the wage you are able to earn when you return to work is less than what you receive in TTD benefits, temporary partial benefits will make up the difference. Workers with a TPD can earn benefits equal to the difference between their wage and TTD for up to 24 months.
  • Permanent Partial Disability (PPD): If you become stable after an injury, but your full physical abilities have not been restored, you may be eligible to receive permanent partial disability benefits. Your PPD rating will depend on your age, wage, injury type, and medical evaluation. Payments typically continue until workers reach age 70.
  • Permanent Total Disability (PTD): If a doctor finds that you have been rendered permanently and totally disabled after a work injury, you will become eligible to receive benefits in an amount not exceeding 66.6 percent of your average income prior to the injury.
  • Medical expenses: As long as you use an authorized medical provider, your medical treatment, assistive equipment, hospital stays, medications, and mileage or travel expenses incurred when visiting the doctor will be reimbursed if your workers’ compensation claim is successful.
  •  Rehabilitation costs: You can seek compensation for physical therapy and rehabilitation to heal from your on-the-job injury.
  • Vocational rehabilitation: If you are unable to return to your previous job, you may be entitled to vocational rehabilitation services. These can include job retraining classes, other education expenses, or help to find a job that meets your new physical restrictions. You may also be entitled to compensation while you’re completing vocational rehabilitation. Vocational rehabilitation may last between 9 and 18 months, depending on your disability rating.

Henderson Workers Comp Attorneys

Guiding You Through This Difficult Time

The actions you take after a workplace injury can make a difference in the challenges you face in the future. Attempting to negotiate with the insurance company on your own, failing to follow the advice of your medical treatment team, posting on social media, and even missing a deadline or filling out the wrong form could cost you significantly.

How Will A Workers’ Comp Claim Affect My Job?

Since all employers are required to carry workers’ compensation insurance in Nevada, filing a claim should not be viewed negatively by management. In fact, it is illegal for your employer to harass you about a workers’ compensation claim or fire you because of the injury. If any of these things occur, or if your employer refuses to give you the necessary information about filing a claim, a personal injury lawyer with workers’ compensation experience should be contacted immediately.

Do I Need Legal Representation After A Work Injury?

In Nevada, the process for filing a workers’ compensation claim and retaining your rights to further legal action is extremely strict. If the injury isn’t reported and a claim isn’t filed within a specified time period, you may lose your right to recover compensation. For this reason, it is important to begin working with an injury attorney as soon as possible. While you may not need to file any additional claims above and beyond the insurance, only an experienced workers’ compensation attorney can help you make this decision.

Many workplace injuries, that escalate into legal filings, have caused permanent disability. While workers’ comp insurance will pay medical bills and lost wages, compensation is usually not enough to cover the costs of a permanent disability.

How Will Having An Attorney Help Me?

Enlisting the help of a workplace accident lawyer can make navigating the workers’ compensation claim process easier in a number of ways. These include:

  • Offering guidance and advice: Filing an insurance claim for workers’ compensation can seem like a convoluted process to those who have been injured. Our workers’ compensation attorneys will guide you through the claims process, ensuring you meet important deadlines, representing you at hearings and appeals, and helping you make informed decisions about your case.
  • Fighting for a larger settlement: The settlement gained from a work-related injury claim can vary dramatically depending on how much impact the injury has on your future. Our work injury lawyers have the skills needed to help you prove the extent of your injuries and ensure you recover as much money as necessary to secure your financial future.
  • Representing you in court: While workplace injury suits are often settled out of court, many must be resolved in the courtroom. Our lawyers will first aim to obtain the highest possible compensation through negotiation of an out-of-court settlement. If a suitable settlement cannot be agreed upon with the insurance company, however, we will pursue compensation in the courtroom.

Frequently Asked Questions

Should I hire an attorney?

To help you determine whether you should hire an attorney to represent you in your injury case, we’ll need to examine your situation. If you were injured in an accident, give us a call for a free case evaluation. We’ll discuss the details surrounding your injury to determine if you have a valid claim.

When I’m choosing an attorney, does education or experience matter most?

While we will make every attempt to settle your injury claim out of court, some cases simply cannot be resolved through a settlement negotiation. From the moment you hire our team, we begin preparing your case for trial. We’ll start collecting evidence, gathering witness statements, and evaluating the strengths and weaknesses in your case. This approach sends a message to the other parties that we are ready to defend your rights and, if a trial is necessary, we are prepared to go to court.

How much will it cost to hire an attorney and get started on the case?

David Boehrer Law Firm handles all personal injury cases on a contingency fee basis. A contingency fee means there is no up-front payment. We get paid only after we win your case. You should check with any firm you decide to hire to make sure they work on a contingency fee basis, as not all personal injury lawyers in Henderson will extend this payment service.

When is the right time to hire an attorney?

If you were seriously injured, you should consider hiring an attorney early on in your case. You can enlist our help at any point during the injury claim process, however. Working with an injury attorney from the very beginning helps ensure that your case gets started off on the right foot.
